The UK Government’s Legislative Programme 2009 - 2010

On 29 June 2009 the UK Government published its draft legislative programme for 2009 - 2010. For the third successive year, the UK Government consulted on its legislative priorities ahead of the Queen's Speech.

The Queen's Speech to Parliament, outlining the the UK Government Legislative Programme 2009 - 2010  took place on 18 November 2009.

Two of the Bills listed below - The Constitutional Reform and Governance Bill, and the Children, Schools and Families Bill - have been identified as including 'framework' (Measure-making) powers for Wales. Other Bills include provisions relating to Welsh Ministers.

Other Bills which apply to England and Wales or the whole of the UK have also been included in the list.

Constitutional Reform and Governance Bill

This is a wide-ranging Bill covering a number of different policy areas. Many of the proposals have their origins in the 'Governance of Britain' Green Paper published in July 2007. Key areas are:·Establishes a statutory basis for management of the civil service;·Introduces a new parliamentary process for the ratification of treaties;·Provides for the end of by-elections for hereditary peers; Makes provisions to allow for the suspension, resignation and expulsion of Members of the Lords;·Introduces new rules on protests around Parliament;·Introduces new rules on time limits for human rights actions against devolved administrations; Makes various provisions relating to judicial office holders, including the removal of the Prime Minister’s role in the process of appointing Supreme Court judges;·Establishes a new corporate structure for the National Audit Office and a limit to the term of appointment to the office of Comptroller and Auditor General; Introduces measures designed to increase the transparency of financial reporting to Parliament.

The Bill was originally introduced during the 2008 - 09 Session. A carry over motion was made on 20 November 2009 allows for any proceedings not completed at the end of that Session of Parliament to be resumed in the current session.

04/11/09 The UK Government put down an amendment to the Bill which would grant framework (Measure-making) powers to the Assembly in respect of the Auditor General for Wales. It includes the power to make Measures regarding “The oversight or supervision of the Auditor General or of the exercise of the Auditor General’s functions” which would strengthen the Assembly’s ability to legislate for independent supervision of the Auditor General for Wales. The amendment was agreed and the new clause added to the Bill on 4 November 2009

Children, Schools and Families Bill

A Bill to make provision about pupil and parent guarantees, home-school agreements, parental satisfaction surveys, children with disabilities or special educational needs, school and other education, governing bodies’ powers and school teachers’ qualifications; to make provision amending the Education Acts; to make provision about Local Safeguarding Children Boards and youth justice; and to make provision about publication of information relating to family proceedings.

Child Poverty Bill

A Bill to set targets relating to the eradication of child poverty, and to make other provision about child poverty.

The Bill was originally introduced during the 2008 - 09 Session. A carry over motion was made on 20 July 2009 allowing for any proceedings not completed at the end of that Session of Parliament to be resumed in the current session.

Equality Bill

The Bill will harmonise and in some cases extend existing discrimination law in anumber of areas. It will address the impact of recent case law which is generally seen as having weakened discrimination protection, and harmonise provisions defining indirect discrimination.

The Bill was originally introduced during the 2008 - 09 Session. A carry over motion was made in May 2009 allowing for any proceedings not completed at the end of that Session of Parliament to be resumed in the current session.

Personal Care at Home Bill

The purpose of the Bill is to help around 400,000 people with care needs. Offer for the first time free personal care at home for those with the highest needs, regardless of means. Be the first step towards setting up a new National Care Service - a simple, fair and affordable care system for everyone.

This Bill applies to England and Wales though the intention is the policy of free personal care will apply in England only.

Welsh Ministers will be given the same power to make regulations in this area as the Secretary of State in England.

Fiscal Responsibility Bill

This Bill received Royal Assent on 10 February 2010.

Fiscal Responsibility Act 2010 (pdf)

The Fiscal Responsibility Bill is intended to provide a "firm and binding statutory basis" for the UK Government's promise to halve its budget deficit within four years. It gives Parliament power to approve medium-term fiscal plans and promises that businesses and investors will have "certainty" about the government's fiscal plans.
